Scope of application<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ce2074b elementor-widget elementor-widget-text-editor\" data-id=\"ce2074b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t1.1 Flughafen Parken GmbH, Terminalstrasse Mitte 18, 85356 M\u00fcnchen-Flughafen (hereinafter referred to as \u201cFP GmbH\u201d) offers users (hereinafter referred to as \u201cCustomer\u201d) a service for arranging airport parking spaces (hereinafter referred to as \u201cInternet portal\u201d) at park.aero. FP GmbH acts exclusively as an intermediary for the airport parking spaces offered on the Internet portal (hereinafter referred to as \u201cparking spaces\u201d).\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-82befd6 elementor-widget elementor-widget-text-editor\" data-id=\"82befd6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>1.2 The Provider of the parking spaces is not FP GmbH, but rather the airport\/parking space operator chosen by the Customer as the contractual partner (hereinafter referred to as \u201cProvider\u201d). The contract concerning the main service (hereinafter referred to as \u201cmain contract\u201d) is thus concluded exclusively between the Customer and the Provider. All claims and obligations arising from the main contract exist directly between the Customer and the Provider.<\/p><p>The following list contains each airport\u00b4s Provider name:<\/p><ul><li>Flughafen Berlin \u2013 APCOA Deutschland GmbH<\/li><li>Flughafen Bremen \u2013 Flughafen Bremen GmbH<\/li><li>Flughafen Dortmund \u2013 Flughafen Dortmund GmbH<\/li><li>Flughafen D\u00fcsseldorf \u2013 Flughafen D\u00fcsseldorf GmbH<\/li><li>Flughafen Frankfurt \u2013 Fraport AG<\/li><li>Flughafen Hamburg \u2013 Flughafen Hamburg Konsortial- und Service GmbH &amp; Co. OHG<\/li><li>Flughafen Hannover \u2013 Flughafen Hannover-Langenhagen GmbH<\/li><li>Flughafen K\u00f6ln\/Bonn \u2013 Flughafen K\u00f6ln\/Bonn GmbH<\/li><li>Flughafen Memmingen \u2013 Flughafen Memmingen GmbH<\/li><li>Flughafen M\u00fcnchen \u2013 Flughafen M\u00fcnchen GmbH<\/li><li>Flughafen N\u00fcrnberg \u2013 Flughafen N\u00fcrnberg Service GmbH<\/li><li>Flughafen Paderborn\/Lippstadt \u2013 Flughafen Paderborn\/Lippstadt GmbH<\/li><li>Flughafen Stuttgart \u2013 APCOA Deutschland GmbH<\/li><li>Flughafen Salzburg \u2013 Carport Parkmanagement GmbH<\/li><li>Flughafen Wien \u2013 Flughafen Wien AG<\/li><\/ul><p>The contractual relationship with the Provider is governed by the general terms and conditions which the Provider stipulates and which are brought to the attention of the Customer during the booking process on the Internet portal. The Customer is advised to read the Provider\u2019s general terms and conditions of business carefully, as contract-relevant information (e. g. terms of payment, provisions on liability, cancellation or rebooking) is derived from these.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a0de8f9 elementor-widget elementor-widget-text-editor\" data-id=\"a0de8f9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>1.3 The following General Terms and Conditions of Business (hereinafter referred to as \u201cGTC\u201d) shall apply exclusively to the contracts concluded between FP GmbH and the Customer for the arrangement of parking spaces (hereinafter referred to as \u201cthe Brokerage Agreement\u201d). These General Terms and Conditions shall also apply in the event of conflicting terms and conditions of a Customer intending to book a parking space. These shall not be accepted even if FP GmbH performs services in knowledge of the Customer\u2019s terms and conditions of business, unless expressly agreed otherwise.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe012e2 elementor-widget elementor-widget-text-editor\" data-id=\"fe012e2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>1.4 FP GmbH works with partners (e.g. airlines, travel agencies and marketing agencies) who forward customers to the FP GmbH Internet portal via their own online presences or third-party online presences for the purpose of booking parking spaces. The upstream involvement of these partners does not result in any special features for the booking; in particular, these General Terms and Conditions also apply to these bookings.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ec27196 e-flex e-con-boxed e-con e-child\" data-id=\"ec27196\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d9f35fa elementor-widget elementor-widget-heading\" data-id=\"d9f35fa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">2. Conclusion of contract, information on the booking procedure<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b7a521 elementor-widget elementor-widget-text-editor\" data-id=\"1b7a521\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>2.1 By completing a booking the Customer offers FP GmbH a binding offer to conclude the mediation contract and the main contract with the Provider. FP GmbH accepts the Customer\u2019s contractual offer contained in the booking as a representative and authorised receiving agent of the respective Provider.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-770710a elementor-widget elementor-widget-text-editor\" data-id=\"770710a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>2.2 The mediation contract is concluded by the acceptance of the offer by FP GmbH; the main contract is concluded by the acceptance of the offer by the Provider, about which the Customer is informed with the booking confirmation by e-mail.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4a9fe06 elementor-widget elementor-widget-text-editor\" data-id=\"4a9fe06\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>2.3 The booking data, these Terms and Conditions, as well as the Provider\u2019s general terms and conditions will be sent to the Customer by e-mail.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-67ff3a3 elementor-widget elementor-widget-text-editor\" data-id=\"67ff3a3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>2.4 The Customer is obliged to check all data for correctness before completing the booking request. FP GmbH provides the Customer with appropriate, effective and accessible technical means by means of which the Customer can identify and correct input errors before submitting his booking.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-193c2db elementor-widget elementor-widget-text-editor\" data-id=\"193c2db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>2.5 In addition, the Customer is obliged to immediately check the data listed in the booking confirmation for correctness and completeness and to inform the Provider of any deviations from the booking request immediately. If the Customer does not find a booking confirmation in his e-mail client and\/or in his spam folder, this must also be communicated directly to the Provider. The contact details of the respective Provider are listed in the booking confirmation and <a href=\"https:\/\/park.aero\/en\/contact\" rel=\"noopener\">here<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-8599943 e-flex e-con-boxed e-con e-child\" data-id=\"8599943\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-093cb6d elementor-widget elementor-widget-heading\" data-id=\"093cb6d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Prices, terms of payment<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-99c12c8 elementor-widget elementor-widget-text-editor\" data-id=\"99c12c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>3.1 The prices displayed by the respective Providers during the booking process are final prices including taxes.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b020d3 elementor-widget elementor-widget-text-editor\" data-id=\"4b020d3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>3.2 FP GmbH does not charge the Customer any fees for the mediation services of FP GmbH (intermediation contract).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fec9321 elementor-widget elementor-widget-text-editor\" data-id=\"fec9321\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>3.3 Payment processing for parking space reservation (main contract) is carried out by the Provider (so-called direct collection). The terms of payment (especially the due date) result from the general terms and conditions of business of the respective Provider. Depending on the chosen means of payment, fees may be charged, which are shown during the booking process.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77cf4fc elementor-widget elementor-widget-text-editor\" data-id=\"77cf4fc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>3.4 The Customer is offered the usual cashless means of payment within the booking procedure. The accepted means of payment depend on the respective Provider.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-fe6adbe e-flex e-con-boxed e-con e-child\" data-id=\"fe6adbe\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-30df3a4 elementor-widget elementor-widget-heading\" data-id=\"30df3a4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4. Complaints, cancellations, rebooking<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f1c7e6 elementor-widget elementor-widget-text-editor\" data-id=\"1f1c7e6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>4.1 In the event of complaints by the Customer, FP GmbH\u2019s obligation is limited to the provision of all information that is relevant for the Customer, in particular the notification of the address and the contact data for the respective Provider. FP GmbH shall not be obliged to accept and\/or forward relevant declarations or documents of the Customer to the Provider.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-795d868 elementor-widget elementor-widget-text-editor\" data-id=\"795d868\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>4.2 The Customer is informed that there is no legal right of withdrawal for the services mediated by FP GmbH in accordance with the applicable legal provisions on the distance selling contract (cf. Section 312g Paragraph 2 Sentence 1 No. 9 of the German Civil Code \u2013 BGB).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-de1806e elementor-widget elementor-widget-text-editor\" data-id=\"de1806e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>4.3 In addition, the Customer is informed that FP GmbH only mediates contracts for services for which there is no general statutory right of rescission in accordance with the applicable statutory provisions with regard to the main service owed by the Provider.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aeade7e elementor-widget elementor-widget-text-editor\" data-id=\"aeade7e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>4.4 However, the Providers mediated by FP GmbH grant the Customer a right to cancel a booking in accordance with the following provisions.<\/p><ul><li>There is no right of cancellation if the mediated main service is expressly advertised as being non-cancellable. Cancellation is excluded in these cases. It is the Customer\u2019s responsibility to check this.<\/li><li>Otherwise, it is possible to cancel a booking on the Internet portal <a href=\"https:\/\/park.aero\/en\/cancellation\" rel=\"noopener\">here<\/a>. The Customer can cancel the booking by entering the Provider, the e-mail address used for the booking and the booking number before the date of arrival. Cancellation is subject to the general terms and conditions of the respective Provider, which may also contain regulations on cancellation fees.<\/li><li>If the Customer\u2019s cancellation fails, this must be reported directly to the Provider.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-62fb993 elementor-widget elementor-widget-text-editor\" data-id=\"62fb993\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>4.5 Changes to the booking are not possible (e. g. other parking area or another parking period). In these cases, the Customer must cancel the booking and make a new booking.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-994b6b7 e-flex e-con-boxed e-con e-child\" data-id=\"994b6b7\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8eef2c4 elementor-widget elementor-widget-heading\" data-id=\"8eef2c4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Warranty and liability<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b2ad465 elementor-widget elementor-widget-text-editor\" data-id=\"b2ad465\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>5.1 All of FP GmbH\u2019s own contents and information have been compiled with the utmost care. However, no warranty can be given for any errors in data acquisition or data transmission.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fdd0b88 elementor-widget elementor-widget-text-editor\" data-id=\"fdd0b88\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>5.2 The respective Provider bears sole responsibility for the accuracy, completeness and up-to-date status of the information provided by the Providers on the Internet portal, including the prices and availability of parking spaces.
